Background
Our client was coerced by a partner into permitting transactions on her account. Monzo added a first-party fraud marker after the funds were recalled.
The challenge
First-party markers carry the highest evidential threshold. Monzo required proof of coercion which the client had struggled to gather alone.
Actions taken
- Coordinated with domestic abuse charities for supporting statements
- Obtained the police non-crime report and social services records
- Prepared expert submission under CIFAS' coerced-transaction guidance
- Direct engagement with Monzo's financial crime team
Outcome
Monzo accepted the coercion evidence, removed the marker, and paid £3,200 in acknowledgement of the additional harm caused by the marker itself.
